This Agreement is made between The Cake Crush, a company incorporated under relevant laws of India, having its registered office at [Insert Address] (hereinafter referred to as “TCC”), and any individual or entity (“Customer”/”End-User”) who purchases products or avails services from TCC.

1. Definitions

In this Agreement, unless the context otherwise requires:

“TCC” refers to The Cake Crush.
“Customer” or “End-User” refers to any person or entity using our Site or purchasing our products.

“Products” include all cakes, baked goods, sweets, and related items offered by TCC.

2. Privacy Policy

TCC values and protects the privacy of all Customers. Any personal data shared on our Site may be used by TCC to process orders, communicate updates, and support and improve services, in accordance with our Privacy Policy.

3. Order Acceptance

All online orders placed by Customers constitute offers to purchase Products.
TCC reserves the right to accept or decline orders at its discretion and will confirm acceptance by dispatching the Products.
In case of stock limitations or unavailability, TCC will notify the Customer and may offer alternatives or process a cancellation and refund.

4. Price & Payment

All prices are displayed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
Payment must be completed through the Site using authorized payment gateways.
Prices are subject to change without prior notice, but such changes will not affect orders already confirmed by Customers.

5. Delivery & Pickup

Delivery will be made to the address provided by the Customer at checkout. TCC is not liable for delays or non-delivery due to incorrect information or recipient unavailability.
Self-pickup is available at our store during designated hours.
Any delivery timelines displayed are estimates and not guaranteed.

6. Cancellation & Refunds

Orders may be cancelled up to 24 hours before the scheduled delivery or pickup time.
Cancellations made after this period, or same-day orders, are not eligible for refunds.
Custom-made cakes cannot be cancelled once confirmed.
Refunds, if applicable, will be processed to the original payment method within 7–10 working days.

7. Product Variations & Allergen Disclaimer

Each cake is handcrafted; therefore, slight differences in decoration, color, or presentation may occur.
Products may contain or come in contact with milk, eggs, nuts, soy, gluten, and other allergens. Customers with allergies should take precautions and may contact us for ingredient details.

8. Liability Limitations

TCC’s liability is limited to the value of the order.
TCC is not responsible for any loss or damage resulting from improper storage, mishandling after delivery, or external circumstances beyond our control.

9. Intellectual Property

All content on the Site—including text, images, logos, and designs—is the intellectual property of The Cake Crush.
Unauthorized use, reproduction, or distribution of any content is prohibited.

10. Force Majeure

TCC shall not be liable for failure to perform obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, transport delays, or technical failures.

11. Indemnity

Customers agree to indemnify and hold TCC harmless from any third-party claims arising from Customer’s breach of this Agreement, misuse of the Products, or violation of any applicable laws.

12. Governing Law & Dispute Resolution
